1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of Hey Anna, including our web application, APIs, and related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to these Terms.
2. Eligibility and Accounts
You must be at least 13 years old to use the Services. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. You must provide accurate registration information and keep it current.
3. The Services
Hey Anna provides AI-assisted spreadsheet and analytics tools, including data upload, workspace editing, chat, and optional report publishing. Features, models, limits, and availability may change over time, including by plan tier, invite status, rate limits, and operational constraints.
4. Customer Content and License
"Customer Content" means data, files, prompts, messages, report content, and other material you upload, submit, or generate in the Services.
You retain ownership of your Customer Content. You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display Customer Content only as needed to provide, secure, maintain, and improve the Services.
You represent that you have all rights and permissions required to provide Customer Content and that your use does not violate any law or third-party rights.
5. AI and Model Output
The Services may generate outputs using third-party and first-party AI systems. Outputs may be incomplete, inaccurate, offensive, or unsuitable for your use case. You are solely responsible for reviewing and validating all outputs before use, publication, or reliance.
We do not use Customer Content to train our own models, and we configure third-party API model integrations so API customer content is not used for model training.
No output constitutes legal, medical, financial, tax, regulatory, or other professional advice.
6. Acceptable Use
You may not use the Services to:
- violate law or infringe intellectual property, privacy, or other rights;
- upload malware, malicious code, or attempt unauthorized access;
- interfere with service integrity, security testing boundaries, or availability;
- submit prohibited regulated data when you lack legal authority to process it;
- abuse scraping, automation, or rate limits beyond authorized use.
7. Public Reports and Sharing
If you publish a report, it may be accessible to anyone with the report link until unpublished. Published links are random and secret, but anyone with the link can view the published report.
Published links show report content only and do not provide direct access to your private workspace or source files. You are responsible for deciding what to publish and for any consequences of sharing links.
8. Third-Party Services
We may rely on third-party infrastructure and providers (for example cloud hosting, model providers, analytics, and monitoring). Your use of integrated third-party functionality may also be subject to those providers' terms and policies.
9. Fees, Plan Terms, and Refunds
Paid features are billed under the pricing and billing terms presented at purchase. Payments are processed by our merchant of record, Paddle, which handles billing, sales tax, and payment processing on our behalf.
If you are not satisfied with your purchase, you may request a refund by contacting us at [email protected]. Refund requests are reviewed on a case-by-case basis and processed through Paddle in accordance with applicable consumer protection laws. We aim to respond to refund requests within five business days.
You may cancel your subscription at any time through the Services or by contacting support. Cancellation takes effect at the end of the current billing period.
10. Suspension and Termination
We may suspend or terminate access, with or without notice, if we reasonably believe you violated these Terms, created security or legal risk, or abused the Services. You may stop using the Services at any time.
You can delete datasets and unpublish reports through product controls. Deleting a dataset removes associated stored dataset artifacts and dataset-linked published report records from active service systems.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEY ANNA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
13. Indemnification
You agree to defend, indemnify, and hold harmless Hey Anna and its affiliates, officers, employees, and suppliers from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, Customer Content, or violation of these Terms.
14. Governing Law
These Terms are governed by applicable law in the jurisdiction where Hey Anna is organized, without regard to conflict-of-law principles, unless mandatory law requires otherwise.
15. Changes to Terms
We may update these Terms from time to time. Updated Terms are effective when posted. Continued use after the effective date constitutes acceptance of the updated Terms.
